Practice Sports, Inc. Standard Terms and Conditions

*Purchase of any item from Practice Sports, Inc./College Sports, Inc. & any of our operating websites, indicates your approval of the terms outlined below, and any post-purchase arbitration or compensation will be subject to these terms.

General Info for Limited Warranty / Return Policy:

  • In the event of a defect under this warranty, we will, at the manufacturer's discretion, send replacement material, request the item be returned for repair, issue a partial credit, or fully replace the item when deemed appropriate.
  • This warranty does not cover damages caused by normal wear and tear, misuse, weather, improper handling, improper installation, or improper maintenance.
  • For netting, manufacturers defects are limited to the knotting, binding and construction of the net. Holes being punched in the netting and/or worn and broken netting are not included within this warranty.
  • All initial shipping costs related to returning products to Practice Sports, Inc. / College Sports, Inc. will be the responsibility of the customer.
  • If a product is determined to be defective, shipping costs may be reimbursed at the discretion of the manufacturer.
  • Alteration or modification of the product voids any warranty.
  • It is normal course for the replacement parts/products to be shipped after the original parts/products have been received by Practice Sports, Inc. / College Sports, Inc. If a customer desires that the replacement items be sent prior to receipt of the return, then the customer will be charged full price for the items and shipping, and will be credited the price of the items upon receipt of the returned items (freight will not be credited - custom items are never eligible for return or credit).
  • This limited warranty is exclusive and in lieu of all other warranties including warranties of merchantability and fitness for a particular purpose. Practice Sports, Inc. & College Sports, Inc. shall not be liable for any incidental or consequential damages of any nature whatsoever.

Liabilities (applies to Practice Sports, Inc. / College Sports, Inc. and any subsidiaries/contractors):

  • We are not liable for costs incurred to move equipment after it has been installed (if we are providing 'Installation Services').
  • If PS was at fault for a manufacturing or installation error which required the equipment to be re-installed or modified, PS is liable for the costs to modify the system to the proper condition only. PS is not liable for loss of income sustained during any potential down-time arising as a result of these manufacturing errors.
  • PS is not liable for re-installation of equipment manufactured by others, such as electric winches.
  • We are not liable for any damages or injuries sustained as a result of the use of our equipment - client has sole responsibility for inspection & maintenance of all equipment, prior to each use, including the first use.
  • We recommend regular safety inspections (frequency depends on usage) to ensure all equipment is still in original & safe working order -- contact us for a quote on our Installation Services.
  • It is the customer's responsibility to properly assemble & use our equipment.
  • If unfamiliar with installing equipment, the services of a professional company should be engaged - contact us for a quote on our installation services.
  • It is the customer's responsibility to perform regular safety inspections to ensure the product has not been compromised.
  • Netting can be damaged by a variety of factors, including but not limited to: animals, weather, vandalism, misuse -- netting should be inspected frequently before use to ensure no holes have developed which could cause injury -- we are not responsible for any injuries as a result of netting breaking, as this is an inherent risk with the use of netting for hard-ball sports use.

Credits / 30-Day Guarantee:

  • Practice Sports, Inc. / College Sports, Inc. will issue credit (when deemed appropriate by the manufacturer) to our customers.
  • The level of credit is based on the discretion of the manufacturer for each particular item.
  • Return timelines for unused goods are at the discretion of the manufacturer, but typically may be made within 30-days of purchase, and carry a 15%-35% restocking fee (credits will be issued within 30-days of receipt of return).
  • Custom fabrication orders may not be returned for credit or refund - contact us to determine if your custom item qualifies for a return and/or credit of any amount.
  • If there is damage or noticeable wear as a result of your usage, no credit will be issued.
  • Customer's are liable for any freight costs incurred as a result of a return, unless determined that the item is defective and warrants a full refund or replacement.

If you would like to return an item email us and provide us with the following:

  • Your name and address
  • An basic explanation of the reason for return (your request will not be challenged - this is for business purposes only).

When the above information is received, an authorization number will be issued by College Sports, Inc. as well as further instructions for returning your item and receiving your credit.

When returning the item, please follow the below directions:

  • Include proof of original purchase (receipt/invoice etc.)
  • Product should be well packed in a sturdy carton to prevent damage in transit. All shipping damage is the responsibility of the consumer.

Payment Terms:

Schools / Government Agencies / Municipalities:

  • Payment: Full payment due within 30 days after ship date, or 5 days after arrival of equipment - whichever is later or balance will be subject to finance charges.
  • Terms Agreement: Payment Terms exceeding 30 days after ship date must be approved by Practice Sports in advance of shipping and may require an additional charge for processing.
  • Certified Purchase Order must be received in advance, including signed Contract, Terms for Entity, and Invoice Payment Contact information prior to order processing.
  • Purchase Orders may be faxed to 1-800-577-3046.
  • Certain items may require 50% down-payment prior to fabrication.
  • When PSI installation services are engaged, 50% deposit required prior to scheduling, with balance due at completion on job-site.
  • Payments accepted via Check or Money Order.
  • Remit payments to Practice Sports, Inc. 14706 Giles Rd, Omaha, NE 68138.
  • Delinquent balances are subject to 3% finance charges accrued monthly, and a discretionary late fee.
  • If litigation is required, College Sports, Inc. & Practice Sports, Inc. hold jurisdiction, and the customer will be required to travel to Omaha, Nebraska for all proceedings involving litigation.

Commercial Entities / Private Individuals / Independent Financiers:

  • 100% of balance due in advance, unless we are performing installation services.
  • 50% of balance is due in advance when utilizing our installation services - payable via Personal Check, Certified Check, Money Order or Credit Card (prior to order being processed).
  • Remaining Balance due on job-site immediately upon completion of project - payable ONLY via Certified Check or Money Order.
  • Keys for equipment will NOT be provided until full payment is received.
  • Practice Sports, Inc. will retain FULL ownership to all equipment until 100% of balance has been paid.
  • Practice Sports, Inc. has the right to recover equipment from client premises through repossession company when full payment has not been fulfilled.
  • Please remit payments to Practice Sports, Inc. 14706 Giles Rd, Omaha, NE 68138.
  • Delinquent balances are subject to 3% finance charges accrued monthly, and a discretionary late fee.
  • If litigation is required, College Sports, Inc. & Practice Sports, Inc. hold jurisdiction, and the customer is required to travel to Omaha, Nebraska for all proceedings.

Shipping/Handling:

  • Shipping/Handling/Insurance is approximately 15%-20% of total NORMAL RETAIL PRICE (minimum of $5).
  • Most all in-stock items will be processed and packaged the SAME business day as submitting your order.
  • Most items ship via UPS Ground, and standard transit time is approximately 1-5 business days, based on location. Heavy items will ship via Truck Line and may take 1-2 days longer.
  • Shipping to a Business address is approximately $50-$80 cheaper than a Residential address (per shipment).
  • Expedited shipping is available for an additional cost. Please contact us for a quote.
  • When Practice Sports is traveling remotely for installation, job-site materials will need to be received by client in advance of crew’s arrival. Crew can only travel upon confirmation of safe arrival of materials.
  • PS requires all materials placed in secure location, within approximately 50 yards of job-site area, to allow PS personnel to hand transfer materials.
  • If materials will be placed beyond 50 yards, PS will require assistance from owner with transporting items to job-site. If assistance is not available, PS will need to rent additional machinery to assist in transporting items – these charges would be the responsibility of the owner.
  • PS will provide minimum 3 days notice prior to arrival of shipment at the client’s facility.

Timelines:

  • We do our best to meet estimated timelines, but can not guarantee our equipment will arrive within any specific timeline, nor are we bound to fulfill any specific timelines, unless otherwise arranged & agreed to by Practice Sports, Inc. & client.
  • When involved in installation, Practice Sports requires minimum of 6-12 weeks lead-time to fabricate parts and travel to job-site, pending size & scope of job.
  • Practice Sports will coordinate specific delivery windows to the best of our ability for delivery of equipment, subject to commercial freight carriers transit timelines, which are out of the control of PS.
  • Practice Sports will provide specific arrival times of personnel to arrive on-site to begin installation, within a 24 hour window.
  • Practice Sports can provide projected completion timelines for installation projects, within a 48 hour window. Requested completion deadlines must be negotiated and agreed to by PS in advance of project.
  • We are not liable for any expenses or monies lost as a result of our equipment not arriving within your schedule.
  • Any timelines provided are only estimates, and subject to delay
  • Please order equipment well in advance to avoid any potential issues caused by unforeseen delays such as: trucking company delays, materials shortage, weather, illness, accidents, natural disasters, etc.
  • Orders can be expedited for a fee when urgent -- please contact us for details.

Minimum Orders:

There is a $100 order minimum for custom netting.

Price Changes:

We do our best to maintain stable prices, however, due to several variables outside of our control, all prices are subject to change without notice. Prices currently reflected on the site are accurate.

Canceled Orders:

In-stock orders may be canceled at any time prior to shipping. Once an order has been shipped a minimum 15% restocking fee will apply, in addition to the return shipping charges. Custom orders and certain items (such as turf, poles, and other over-sized or specialty items) are not eligible for a return / refund.

Practice Sports, Inc. reserves the right to bill up to $150 / hour for time exhausted on a project, regardless of materials being shipped. The billing potential for a project begins upon client's digital signature / order authorization.

Product Stock:

Most products will be in stock, with the exception of custom sized cages, pitching machines, field covers, wind screens, turf, and a few others. We can not guarantee stock on any items, so please contact us to check our up-to-date inventory availability.

Damaged Goods:

Damaged goods or shortages must be reported to us within 2 days of receipt of the order. If merchandise is damaged during shipping, a claim must be made immediately with the delivery carrier, noted on the bill of lading or the truck bill when the goods are delivered.

*If the customer accepts receipt of goods and does not bring damage to the attention of the delivery carrier, the customer typically assumes all responsibility for the damage - in MOST cases - some exceptions are made, i.e. if item was delivered when customer was not home etc., but recourse is MUCH more likely if the driver notates it on the Bill of Lading.

Practice Sports, Inc. Installation Terms

General:

  • Electronic signature on practicesports.com (hereinafter PSI) represents binding agreement with terms below.
  • Electronic signature on practicesports.com below certifies that the specifications & pictures provided (if applicable) are accurate and revealing.
  • If the specs provided are not accurate, modifications to the equipment may be required, which will result in additional hardware & labor charges. The up-charges would be reviewed with the appropriate personnel before proceeding. If the charges are not accepted, there will be a minimum additional charge of $500 to compensate for travel expenses (if applicable), as well as labor charges for the amount of labor exhausted up to that point (when applicable), and equipment will be removed and possession retained.
  • If job-site is not in adequate condition to allow for job completion, or there is not sufficient access to install the equipment in a proper manner according to PSI's high standards, PSI maintains right to leave job-site based on discretion of PSI's crew-chief.
  • If client elects to cancel job prior to completion, or job conditions are inadequate, there will be a minimum additional charge of $500 to compensate for travel expenses (if applicable), as well as labor charges for the amount of time exhausted up to that point (when applicable at up to $150 / hr), and equipment will be removed and possession retained.
  • If equipment is returned or cancelled after production has begun, "stock / standard sizes" are subject to a 25% re-stocking fee -- custom systems are not refundable.
  • Timelines can not be guaranteed, due to weather or other unforeseen events -- please schedule your installation around your deadline leaving room for delay to prevent problems - we are not liable for wages or income lost as a result of any delays.
  • Small variations in the net size may require the frame size to be altered slightly -- signicant modications (beyond 6" in deviation or those which affect the operation or use of the net system) will be reviewed with client.
  • A scissor-lift is required to be furnished by client if ceiling height is greater than 25 ft. (where applicable).
  • Crew requires exclusive access to lift.
  • Crew requires exclusive access to area of installation.
  • Any delays caused by lift inaccessibility or obstruction from other contractors may result in an up-charge for additional labor.
  • Final electrical hard-wiring is the responsibility of the client. Installation crew (if applicable) will install an "electrical jumper" unit to test and demonstrate proper use of the system.
  • Crew is not responsible for staying on site until hard-wiring has been complete.
  • The job will be considered complete upon demonstration of the cage functionality using the electrical-jumper.

Payment Terms (Practice Sports, Inc. hold Interest in the equipment until full payment is received):

  • We are not liable for costs incurred to move equipment after it has been installed (if we are providing 'Installation Services').
  • We are not liable for wages or income lost as a result of any delays, or damage/malfunction by the system.
  • We are not liable for any damages or injuries caused by equipment upon completion of our installation services.
  • We recommend regular safety inspections (frequency depends on usage) to ensure all equipment is still in original & safe working order.
  • Each client is responsible for identifying local fire codes and directing Practice Sports, Inc. how to position the cages in compliance with any codes or regulations.
  • We are not liable for costs, injuries, or damages created as a result of cage location.
  • Our crew will review the location of the equipment in advance of installation -- if there are any potential issues which could be caused as a result of the position of the cage or any hardware, please notify our crew-chief while ON SITE to review any potential modifications.
  • Our crew-chief will review the completed job with an authorized representative prior to leaving job site -- if there are any concerns with standard operation of equipment or any hardware, please notify our crew-chief while on site.

Warranties:

  • Cage System: 5-year limited warranty
  • Netting: 2-year limited warranty
  • Other equipment: Subject to manufacturer's warranty
  • Installation Services: 30-day limited warranty -- return trip based on discretion of crew-chief. Pictures will be required -- if it is determined alterations have been made to system which caused the malfunction, there will be a charge for the service-call.
  • Any modifications to the system void warranty & liability.
  • Our crew will review the location of the equipment in advance of installation -- if there are any potential issues which could be caused as a result of the position of the equipment, please notify our crew-chief while ON SITE to review any potential modifications.
  • Our crew-chief will review the completed job with an authorized representative prior to leaving job site -- if there are any concerns with standard operation of cage or any hardware, please notify our crew-chief while on site.
  • Parts will be replaced on a discretionary basis, and in most cases will not result in the entire system being replaced.
  • PSI owns all parts removed from repaired products. PSI uses new and reconditioned parts made by various manufacturers in performing limited warranty repairs and equipment replacement products. If PSI repairs or replaces a product, its limited warranty term is not extended.
  • If a winch issue occurs, the manufacturer's warranty will apply, which is typically 1 year. Winch failure or maintenance does not obligate PSI to replace or repair even when involved in the original installation. All replacement parts are subject to the discretion of the manufacturer, and all costs to re-install shall be borne by the client, unless the manufacturer agrees to offer compensation. We will assist with the claim process.
  • If a defect occurs with any piece of equipment installed by PSI, the manufacturer's warranty will apply. A defect or product failure does not obligate PSI to replace or repair even when involved in the original installation. All replacement parts are subject to the discretion of the manufacturer, and all costs to re-install shall be borne by the client, unless the manufacturer agrees to offer compensation. We will assist with the claim process.

*All conduit wiring, junction boxes and components not specified herein shall be furnished and installed by the electrical contractor. All material is guaranteed to be as specified. If an item is not listed, it is not included. Any alteration or deviation from specifications involving extra costs will be executed only upon written orders, and will become an extra charge over and above the amount set forth above. We shall not be responsible for delays caused by strikes, accidents, and or other contingencies beyond our control. Owner is to carry fire, tornado, and other necessary insurance. Our workers are fully covered by worker's compensation insurance.

PSI’S RESPONSIBILITY FOR MALFUNCTIONS AND DEFECTS IN HARDWARE IS LIMITED TO REPAIR AND REPLACEMENT AS SET FORTH IN THIS LIMITED WARRANTY STATEMENT. ALL EXPRESS AND IMPLIED WARRANTIES FOR THE PRODUCT, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF AND CONDITIONS OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO THE LIMITED WARRANTY PERIOD SET FORTH ABOVE AND NO WARRANTIES, WHETHER EXPRESS OR IMPLIED, WILL APPLY AFTER SUCH PERIOD. PSI DOES NOT ACCEPT LIABILITY BEYOND THE REMEDIES SET FORTH IN THIS LIMITED WARRANTY STATEMENT OR ANY LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING WITHOUT LIMITATION ANY LIABILITY FOR PRODUCTS NOT BEING AVAILABLE FOR USE OR FOR LOST INCOME.

Warranties

Practice Sports, Inc. Cage Equipment Limited Warranty

Practice Sports, Inc. warrants all frame & cable systems (excluding netting) for a period of 5-years from the date equipment is received.

Practice Sports, Inc. (hereinafter "PSI") manufactures (or has manufactured by a third party) its hardware products from parts and components that are new or equivalent to new in accordance with industry-standard practices. PSI warrants that all hardware products supplied by PSI to you will be free from defects in materials and workmanship.

This limited warranty does not cover damage or affected operation of covered equipment resulting from external causes, including accidents, acts of God, abuse, vandalism, misuse, servicing not authorized by PSI, usage not in accordance with installation instructions, failure to perform reasonable required preventive maintenance, and problems caused by use of parts and components not supplied by PSI.

PSI is not liable for any injury or damage sustained as a result of the use of equipment manufactured or supplied by PSI. Client has sole responsibility for inspection & maintenance of all equipment, prior to each use, including the first use.

All shipments must be inspected at time of delivery for damages or shortages. If damages or shortages occur, it must be noted on the bill of lading and reported to us within 2 business days. Failure to do so will forfeit any claims for damage or shortages with PSI.

During the limited warranty period, PSI will repair or replace covered products that are returned to PSI's designated address. To request limited warranty service, you must contact PSI's Customer Care department, toll-free, at (800) 877-6787 within the limited warranty period.

Photos will be required to be reviewed by PSI before a return authorization is granted. If the defect is not obvious in the pictures, customer may be obligated to return merchandise at their expense - upon inspection of equipment, if item is determined to be defective, freight will be reimbursed and new item will be shipped, at no expense to customer. If item is not determined to be defective, no refund will be issued. Defects are determined at the discretion of PSI and it's manufacturers.

Limited Warranty does not include on-site service or labor from PSI (except when PSI was involved in installation), nor does it obligate PSI to incur any costs related to customer's labor expense to replace or repair item. Replacement parts will be provided (when deemed necessary), installation guides provided, and technical phone support provided to assist customer. If customer does not wish to replace/repair item, item may be fully reimbursed at the discretion of PSI.

If PSI was involved in installation, a 30-day limited service warranty will apply. If equipment malfunctions within this period, PSI may return to job site to repair item - at the discretion of PSI. Pictures & video may be required to determine the magnitude of the issue and enable PSI to properly resolve. In some cases, PSI may engage a 3rd party contractor to service item, when deemed appropriate.

PSI owns all parts removed from repaired products. PSI uses new and reconditioned parts made by various manufacturers in performing limited warranty repairs and equipment replacement products. If PSI repairs or replaces a product, its limited warranty term is not extended.

PSI DOES NOT ACCEPT LIABILITY BEYOND THE REMEDIES SET FORTH IN THIS LIMITED WARRANTY STATEMENT OR ANY LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING WITHOUT LIMITATION ANY LIABILITY FOR PRODUCTS NOT BEING AVAILABLE FOR USE OR FOR LOST INCOME.

Practice Sports, Inc. Netting Limited Warranty

Practice Sports, Inc. warrants all Nylon netting for a period of 2-years, and all Polyethylene netting for a period of 1-year, from the date netting is received.

Practice Sports, Inc. (hereinafter "PSI") manufactures (or has manufactured by a third party) its netting from materials that are new in accordance with industry-standard practices. PSI warrants that all netting supplied by PSI to you will be free from defects in materials and workmanship.

This limited warranty does not cover damage or affected operation of covered netting resulting from normal wear and tear, external causes, including accidents, acts of God, abuse, vandalism, misuse, servicing not authorized by PSI, usage not in accordance with installation instructions, failure to perform reasonable required preventive maintenance, and problems caused by use of parts and components not supplied by PSI.

This limited warranty does not cover imperfections in the appearance of the netting, including but not limited to striations where the netting was seamed, or knots where the netting may have been patched due to a manufacturing error. These are quality control measures and will not inhibit the functionality of the netting.

PSI is not liable for any injury or damage sustained as a result of the use of equipment manufactured or supplied by PSI. Client has sole responsibility for inspection & maintenance of all equipment, prior to each use, including the first use.

Practice Sports, Inc. Artificial Turf Limited Warranty

Practice Sports, Inc. SYNTHETIC TURF LIMITED WARRANTY AGAINST FAILURE DUE TO WEAR AND EXPOSURE TO SUNLIGHT (PE MONOFILAMENT, CFN, XP, LSR)

USED TURF TERMS

  • Used turf may have lines & other markings on it, which may not all line up.
  • Used turf does not include rubber or other in-fill.
  • Used turf carries no guarantees on the condition or quality, and may differ from the online photos.
  • Used turf does not have a guaranteed "pile height", and the spec may differ slightly from the online photos & listing.
  • Used turf has no warranty or returns.
  • Motor freight shipments are curb-side delivery - the customer is responsible for adequate machinery or personnel to unload & transport.

WARRANTY PERIOD

This warranty shall be in force and remain in effect for a period of ten (10) years beginning on the date of invoice ("effective date")

WARRANTY

  1. MANUFACTURING DEFECTS - Practice Sports, Inc. warrants that at the time of the initial invoice, the product will be free of any defects in materials and workmanship. All synthetic turf is subject to normal wear and tear. Normal wear and tear is not a manufacturing defect and is not covered by this warranty.
  2. PILE RETENTION LIMITED WARRANTY - Practice Sports, Inc. warrants that the product will retain at least 50% of its pile fiber when properly installed by an approved installer, and when maintained according to manufacturers guidelines, according to the Synthetic Turf Counsel (STC) recommended turf maintenance procedures.

REMEDY LIMITED TO REPLACEMENT PRODUCT

Practice Sports, Inc.'s Liability under this warranty shall be limited to the replacement of the defective product, on a pro-rated basis, and specifically excludes all costs associated with removal of the defective product and installation of the replacement product. All costs associated with removal of the defective product and installation of the replacement product shall be the sole responsibility of the purchaser. Claims must be submitted in writing to Practice Sports, Inc., once this has been submitted and Practice Sports, Inc. has determined, in its sole discretion, that the product is defective and the defect is covered by this warranty, Practice Sports, Inc. will provide replacement product to the purchaser, F.O.B. Mill, Dalton, Ga., at a reduced price that shall be pro-rated based upon the number of months remaining in the unexpired warranty period. Purchaser shall be responsible for paying the portion of the purchase price for the replacement product which is excluded from coverage under this warranty.

LIMITATIONS AND EXCLUSIONS TO THIS WARRANTY

  1. This warranty only applies to the wear of the product with regard to "normal" foot traffic and ultraviolet degradation, and does not apply to damage incurred during installation, improper underlay, pile crushing, willful or negligent abuses, or damage by machinery or equipment, nor does it apply when turf is not professionally installed by an approved installer.
  2. This warranty does not apply to installations on stairways or other uneven surfaces.
  3. Fluctuation in texturized yarn products, used as face yarn or thatch yarn, is not considered a defect, nor is shade differences due to dye lot changes, and shall not be covered by this warranty.
  4. Slight color changes will occur over the lifetime of this product, and such color changes are not covered by this warranty. Color will not be considered an issue or basis for a claim.
  5. Practice Sports, Inc. shall not be responsible for any costs or expenses incurred by purchaser or others with respect to any tests, inspections, or consultations conducted by the purchaser or others on the product.
  6. This warranty applies to replacement of the product only. All labor costs involved with the removal of the defective product, and the cost of the installation of the replacement product, will be the sole responsibility of the purchaser, and are specifically excluded from coverage under this warranty.
  7. This warranty specifically excludes defects or damages caused by;
    1. Improper installation or repairs.
    2. Burns, cuts, accidents, vandalism, abuse, negligence or neglect.
    3. Improper design or failure of the sub-base of the sports field, green, court, or landscape.
    4. Wear or abrasion caused by inadequate sub-base.
    5. Wear or abrasion under swing sets, slides, and other high friction play equipment.
    6. Wear or abrasion on the seams and other high friction areas.
    7. Wear due to lack of infill / no infill.
    8. Shrinking or melting of fibers due to reflection or other sources of extreme heat.
    9. Movement of product due to lack of infill, improper glue, improper securing of edges.
    10. Expansion and contraction of product.
    11. Use of infill products of an incorrect grade.
    12. Failure to maintain infill products at the correct level (per FIFA accredited test institutes)
    13. Use of inappropriate footwear (cleats) or sports equipment.
    14. The playing surface being used other than for the purpose for which it was designed and installed.
    15. Use of chemicals, herbicides, pesticides.
    16. Use of improper cleaning methods.
    17. Any harmful chemical reaction to the product caused by infill materials.
    18. Acts of God or other conditions beyond the reasonable control of purchaser or Practice Sports, Inc.
    19. Post fibrillation after or during installation for purposes other than to get infill materials in place.
    20. Failure to install seams, lines, logos properly.
    21. Failure to properly maintain, protect or repair the products or turf.
    22. Failure to properly maintain / repair seams, lines, logos.
    23. Packing, matting, or roll crush marks of products as these are inherent characteristics of products manufactured using polypropylene, polyethylene, and nylon fibers.
    24. Product damage occurring during the shipping / transportation process. All shipping claims must be filed against the respective truck lines.

LIMITATIONS ON LIABILITY

Practice Sports, Inc.'s sole liability for any and all damages resulting from any cause whatsoever, whether based in contract, negligence, strict liability, other torts, or otherwise shall be limited to the original price of the product. IN NO EVENT SHALL Practice Sports, Inc. BE LIABLE FOR LOST PROFITS OR REVENUES, LOSS OF USE OR SIMILAR ECONOMIC LOSS, OR FOR INDIRECT SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR SIMILAR DAMAGES ARISING OUT OF, OR IN CONNECTION WITH SUCH CAUSE.

PURCHASER'S OBLIGATION TO INSPECT UPON DELIVERY

Purchaser must promptly inspect all products upon delivery and notify Practice Sports, Inc. in writing of any defects, shortages or non-conformity's within 30 days of receipt of goods. Notwithstanding anything herein to the contrary, if the purchaser fails to promptly inspect and identify product defects, shortages, or non-conformity's which are discoverable by inspection within 30 days of the delivery date, purchaser shall be deemed to have accepted the products "as is", and Practice Sports, Inc. shall have no obligations and / or liability with respect to such defects, shortages.

ASSIGNMENT

Purchaser may not transfer, convey, or otherwise assign all or any rights under this warranty without prior written consent of Practice Sports, Inc. Any such transfer or assignment without prior written consent shall be null and void, and of no force or effect.

REGIONAL DISCLAIMER

All implied warranties whether it's wear or UV issues, for the Sunbelt Regions (California, Arizona, Nevada, New Mexico, Colorado, and Utah) are reduced by 50%.
